Brash was claimed in this league but it wasn't an FAAB claim. Eat at Joe's claimed him and the claim was approved so Brash was on JOE's major league roster over the winter but then not frozen or topped. So I don't see how this situation is different than the one in Bob where he was claimed in FAAB. In both cases he was on someone's major league roster over the winter and eligible to be frozen or topped. One more note for the rules clarifications.

If he was picked last year outside of FAAB then I totally agree with you. Randy can make another pick. randyspears

I'm not entirely happy with the interpretation of the rules in this decision. I'm not sure how a player who is no longer on someone's roster (via freeze or topper) is no longer eligible to be determined to be a minor leaguer since he didn't play in the majors last season. I would think that is the definition of a minor league player/prospect.
When I read the rules, it states that there will be an Available List and a Prospect list, but there were in place this season for obvious reasons.
I've been reading the rules and I don't see this interpretation being valid. Here's what I read: "4.2.3 Each existing team must also submit a minor league freeze, based on its existing minor league roster (Sections 4.4 and 5.7). Minor league rosters are subject to specific rules regarding freezes:"
How does being on a team's roster last season (but not retained this pre-season) make Brash not an eligible prospect? I guess I don't see anything where being on someone's past roster makes a player ineligible to be considered a Minor-League player or prospect.
I will await your response and honor it, but I'm guessing I wanted to get my side of the debate out there.

Joe has the final say but my interpretation of the rules is that he falls under the category of once promoted to the majors by his owner he can't go back to the minors, and I think this should apply even if it's a different owner. The rules clarifications will have to address the fact that he didn't actually play but I think the fact that he was on one of our major league rosters takes precedence.

I've been giving this a lot of thought and I've decided that we should go by what the rules says and not what the founding fathers might have intended. Sounds like a Supreme Court ruling, lol. We are going to allow the claim of Brash to stand. Ed, go ahead and approve it (which is what you wanted to do from the beginning). popeye46 randyspearsRules committee will add this to the list of loopholes to look at though I don't ever recall a situation like this since we have had minor league drafts. Sorry for the flip flopping.

The rules also state that any player not frozen returns to the AVL pool and they also state that any player without any major league stats can be drafted to the minors. It also states that the minor league draft will be held after the major league draft. And we didn't allow Marsh to be selected in the Major league draft. The catch 22 of this is that the team that claimed him last year couldn't freeze him this year because he didn't have a major league at bat or any innings pitched. So it doesn't make any sense to me that he can't be selected in the minor league draft this year. just my two cents

Can we put this issue to bed please. Brash claim is approved. Rules committee will take it up later. End of story.

He has to be eligible for either the major or minor league draft. Clearly we need to look at this rule and clarify it over the summer. Sorry Joe for the extra post, I was writing it while the ones just above appeared.
